Faros Guides is an online marketplace operated by Sandvos Creations LLC (Arkansas) that connects independent fishing guides ("Guides") with anglers ("Anglers") seeking guided fishing experiences. Faros Guides does not employ Guides, does not provide guide services, does not own or operate any vessel, and does not guarantee the quality, safety, or outcome of any trip. We provide the technology platform and tools that allow Guides and Anglers to find each other, communicate, and transact.
By creating an account or using Faros Guides, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the platform.
You must be at least 18 years old to use Faros Guides. By creating an account you confirm that you are 18 or older, that all information you provide is accurate and kept current, and that you have the legal authority to enter into these terms.
Guides are independent contractors, not employees, agents, partners, or representatives of Faros Guides. By listing on Faros Guides you represent and warrant that you:
Anglers agree to accurately represent themselves, their experience level, and their party when making bookings; to honor confirmed bookings and the cancellation policy selected by the Guide; to disclose any relevant medical conditions or physical limitations to the Guide; and to follow all safety instructions provided by the Guide during a trip.
Faros Guides may collect and review documents from Guides, including government-issued identification, fishing guide licenses, and proof of insurance, in order to apply a "Verified" indicator. You acknowledge and agree that:
Faros Guides charges a platform fee on completed bookings, as published on our Fee Promise page. Payments are processed through our third-party payment processor (Stripe). Faros Guides does not store full payment card numbers. Founding Guides and early adopters have their rates locked in as described in our Fee Promise. Faros Guides may adjust fees for new users with advance notice as stated there.
Each Guide sets their own cancellation policy (Flexible, Moderate, or Strict), shown clearly before any booking is confirmed. Weather cancellations initiated by a Guide always result in a full refund to the Angler regardless of the cancellation policy in place. See our Cancellation Policy page for details.

To the maximum extent permitted by law, the Faros Guides platform is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Faros Guides does not warrant that the platform will be uninterrupted, secure, or error-free, or that any Guide, trip, listing, rating, or piece of content is accurate, reliable, safe, or fit for any purpose. Any reliance on a Guide, listing, or content is at your own risk.
Faros Guides is a marketplace platform only. We are not responsible for the acts, omissions, conduct, or content of any Guide or Angler; the quality, safety, or legality of any trip; injuries, death, or property damage occurring before, during, or after a trip; or disputes between users. Guides are solely responsible for the safety of their clients during guided trips.
To the maximum extent permitted by law: (a) Faros Guides and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, personal injury, or property damage; and (b) the total aggregate liability of Faros Guides to any user for all claims shall not exceed the greater of (i) the total platform fees paid by that user to Faros Guides in the twelve (12) months preceding the claim, or (ii) one hundred U.S. dollars ($100).
Guided fishing and boating activities involve serious inherent risks, including but not limited to: death, drowning, serious bodily injury, capsizing, adverse weather conditions, rough water, slipping or falling on vessels or docks, wildlife encounters, sun exposure, dehydration, physical exertion, equipment failure, and collision with other watercraft. These risks exist even when a Guide exercises reasonable care. The listing of these risks is for the purpose of informing users and establishing assumption of risk — it does not constitute an acceptance of liability by Faros Guides, nor does it imply that Faros Guides has any duty to prevent or mitigate them.
By booking a guided fishing trip through Faros Guides, Anglers voluntarily and knowingly assume all such inherent risks of participation. This assumption of risk extends to any minors in your party for whom you are the parent or legal guardian.
Faros Guides is a booking platform only. We do not accompany trips, supervise Guides, inspect vessels, certify equipment, verify water conditions, or control any aspect of the guided experience. Guides are solely and exclusively responsible for the safety of their clients on the water. Faros Guides has no physical presence on any guided trip.
Anglers acknowledge that: (a) they have reviewed the Guide's credentials and insurance status before booking; (b) they have read and signed the Guide's liability waiver; (c) they have disclosed any relevant medical conditions or physical limitations to the Guide; and (d) they will follow all safety instructions provided by the Guide. Nothing in this section limits a Guide's own liability to the Anglers they guide — this section applies solely to Faros Guides as a marketplace platform.
To the maximum extent permitted by applicable law, you agree to release, defend, indemnify, and hold harmless Faros Guides and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal and accounting fees — arising out of or in any way connected with:
This means that if someone sues Faros Guides because of something you did, you agree to cover Faros Guides's legal costs and any damages. This obligation survives termination of your account.
Guides are independent contractors. Nothing in these Terms creates an employment, agency, partnership, joint venture, or franchise relationship between Faros Guides and any user. Faros Guides has no control over, and is not responsible for, the acts or omissions of any Guide or Angler.
Faros Guides provides a messaging platform for Guides and Anglers to coordinate trip details including meeting location, departure time, what to bring, and special instructions. Faros Guides is not a party to these communications and is not responsible for ensuring that Guides communicate with Anglers.
Guide no-shows. If a Guide fails to appear for a confirmed booking without prior cancellation, the Angler is entitled to a full refund of all amounts paid through the platform including platform fees, processed upon verification. Guides who repeatedly fail to honor confirmed bookings may have their accounts suspended or permanently removed.
Platform limitations. Faros Guides's liability for any service failure — including guide no-shows, communication failures, or trip quality disputes — is strictly limited to refunding the fees paid through the platform for the affected booking. We are not liable for travel costs, accommodation, lost wages, or any other consequential damages.
The Faros Guides name, logo, and platform design are proprietary. You may not use them without written permission. Content you post on Faros Guides (photos, descriptions, reviews) remains yours — you grant Faros Guides a non-exclusive, worldwide, royalty-free license to host and display it on and in connection with the platform.
Faros Guides takes reasonable measures to protect your information, as described in our Privacy Policy. However, no method of transmission or storage is 100% secure, and Faros Guides cannot guarantee absolute security. You provide information at your own risk. You are responsible for keeping your account credentials confidential and for all activity under your account.
Faros Guides may suspend or terminate any account at its discretion, including for violation of these Terms, fraudulent or unsafe conduct, or submission of false documents, with or without notice. You may close your account at any time. Provisions that by their nature should survive termination — including liability limitations, indemnification, assumption of risk, and dispute resolution — survive.
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before filing any formal claim, you agree to contact Faros Guides at legal@farosguides.com and give us 30 days to attempt to resolve the dispute informally.
Binding arbitration. If informal resolution fails, you and Faros Guides agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the platform — including any claims for personal injury arising from a guided trip — shall be resolved exclusively through binding individual arbitration, not in court. Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
No class actions. You may only bring claims against Faros Guides in your individual capacity. You waive any right to bring a class action, class arbitration, or representative action.
No jury trial. By agreeing to arbitration, both you and Faros Guides waive the right to a jury trial.
Exceptions. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims relating to intellectual property rights are excluded from mandatory arbitration.
Governing law. These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law principles. Any arbitration shall take place in Arkansas or, at your election, in the county where you reside.
Changes. We may update these terms from time to time. We will notify users of material changes by email at least 30 days before they take effect. Continued use of Faros Guides after that date constitutes acceptance of the updated terms.
Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.
Entire agreement. These Terms, the Privacy Policy, and referenced policies constitute the entire agreement between you and Faros Guides.
No waiver. Our failure to enforce any provision is not a waiver of that provision.
Assignment. You may not assign these Terms; Faros Guides may.
Force majeure. Faros Guides is not liable for any failure or delay caused by events beyond its reasonable control.
